Seller and purchaser agree to the following:
Seller guarantees this Akita to be in good health at the time of sale and upon arrival to the purchaser. Upon taking possession of this Akita, purchaser has 3 business days in which to have an initial exam done on the dog by a licensed veterinarian at purchasers expense. If within 10 days from the date of purchase, the Akita is found to be in poor health attributable to the seller, purchaser may return the dog to the seller at sellers expense for a full refund of the purchase price. A statement from purchasers veterinarian is required and dog must be returned to seller within 3 days of diagnosis for refund. Seller will not be financially responsible for any medical care that purchaser may elect to have done on this Akita.
Every reasonable precaution has been taken to prevent this puppy from aquiring hereditary faults such as hip dysplasia or breed disqualifications. However, due to unknown hereditary and environmental causes of these and other faults, no guarantee can be given against them. However, this Akita shall carry a limited warranty as outlined below:
If said dog does not pass OFA certification of hips (fair or better rating), elbows (normal rating) or is diagnosed with patella luxation of grade 2 or higher at 24-26 months of age and requires euthanasia because of hip and/or elbow dysplasia or patella luxation, seller will replace the dog with one of companion quality from the next available litter, upon written verification in the form of the OFA report(s) as well as proof of euthanasia on the veterinarian’s letterhead. In addition, the dog is warranted up to 5 years of age against VKH, Pemphigus and Sebaceous Adenitis (diagnosed by punch biopsy) as well as hereditary eye defects that causes blindness in both eyes. Seller agrees to provide purchaser with a replacement dog of companion quality when available after receiving written verification from the examining veterinary specialist and in the case of eye disorders, the ophthalmologists report(s), as proof of the dogs affliction. A second opinion from a veterinarian/specialist of sellers choice may be also be required. Purchaser is responsible for transportation costs of replacement dog. Any claims must also be accompanied by written veterinary verification that the disorder is of a complete genetic origin and not the result of neglect on the part of the purchaser, failure of the purchaser to follow sellers recommendations on feeding, supplements, vaccinations and/or exercise, accident or injury. As an alternative to replacement for euthanasia, if purchaser elects to have surgery done on said dog for diagnosed covered disorder, seller will refund ˝ of stated purchase price upon proof of surgery being performed. Stated purchase price is the amount stated on this sales agreement and does not include any shipping fees. This warranty covers only replacement or refund as outlined and does not cover costs of health checks. Torn cruciate ligaments are not covered under this warranty as this issue is caused by injury. Proof of spay/neuter is required.
Seller shall provide purchaser with any advice or assistance pertinent to the care, feeding, grooming, training etc. of this dog.
Growing puppies are not to be fed diets high in fat nor are they to be allowed rough play with older dogs or be forced to exercise as in running/jogging before 2 years of age. Puppies are not to be raised exclusively on slippery flooring such as tile or linoleum as these surfaces allow very little traction which can result in damage to growing bones and joints. Said Akita is to be fed only premium quality foods, either adult or large breed puppy formulas, with meat as a first ingredient, no soy and be naturally preserved with no more than 26% protein and 16% fat content. NO regular puppy foods are to be used, only large breed. We discourage the use of raw diets unless you know exactly what you are doing.
Purchaser is greatly encouraged to use the following supplement guidelines until the Akita is at least 2 years of age for joint/bone health:
Vitamin C tablets - dosed to bowel tolerance, meaning as high a dose the dog can tolerate without developing diarrhea. Vitamin C powder can be used for younger puppies (mix with a small amount of canned food) to make for easier administration. Give twice a day.
Glycoflex – can be purchased from the catalogs named in the recommendation sheet. Dosages are on the bottle. We prefer Glycoflex 2 that has added MSM.
No added calcium supplements are to be given on a growing puppy.
This Akita is to be vaccinated no more than absolutely necessary for your living area. Vaccines are to be split up i.e. rabies vaccine is not to be given at the same time as another vaccine. Any procedures requiring anesthesia should not be done within 3-4 weeks of any vaccine unless that procedure is unavoidable (an emergency) at that time. Please read up on the harm that over vaccinating can do to an animal. Our Akitas are vaccinated no more often than every 3 years once their puppy series of vaccinations is completed.
Purchaser understands that socialization and training is imperative to the overall temperament of this dog. Seller makes no warranties in regards to this dogs temperament. Purchaser agrees to keep this dog under control at all times, crate train and socialize dog with humans and other animals. Seller will not be held responsible for any damages or bodily harm directly or indirectly caused by this dog to property, humans or other animals. Seller highly recommends that purchaser and said dog complete at least a puppy socialization class and an 8 week basic obedience course.
Purchaser understands that the Akita breed is a powerful, serious and dominant dog and as such, may challenge humans for the alpha position. Because of the nature of the breed, it is imperative for the purchaser to establish their dominance over the dog from the very beginning and to always maintain that dominance throughout the dogs life. All dogs have teeth and therefore are able to bite under the right circumstances. The majority of those that are bitten by dogs are children and most times, it is not the dogs fault. The vast majority of dogs give plenty of warning before they actually bite. Biting is a last resort for them and that is why it is important to understand dog body language and behavior. Children are to always be supervised around said dog. The Akita is not the breed for households that have an open door policy to children outside of their family. Seller has provided training and temperament materials to assist purchaser in the proper handling of said dog. If said dog has an unprovoked bite, it is to be humanely euthanized.
If purchaser is no longer able to care for this dog, seller must be contacted before any action is taken. Dog is NEVER to be taken to a shelter or rescue or rehomed without the sellers knowledge and consent and if consent is given, seller is to be kept informed of any changes in ownership with name, address and phone number. If said dog is to be returned to seller, a relinquishment form will be required to be signed by the purchaser turning over complete ownership to seller and seller will do with the dog as they see fit. Purchaser is responsible for transportation costs to get dog back to seller. No refund of any part of purchase price will be given to purchaser.
Purchaser understands that this dog is being sold for the sole purpose of a family companion or working dog (obedience, agility, tracking) and is not to be used for breeding purposes, accidental or otherwise, or conformation competition. Dog is to be spayed/neutered by 8 months of age and AKC limited registration application will be issued to purchaser upon seller receiving proof on veterinary letterhead of spaying/neutering. Breeders prefix of SHIOJIRI will be the first part of dogs registered name in any registry it is registered in.
Purchaser is to maintain this dog in a healthy environment at all times including providing clean, fresh drinking water, adequate food, proper exercise and companionship and medical care including regular veterinary exams and proper vaccinations. Dog is to be kept as a house pet, in a secure kennel run or properly fenced yard with provisions for shelter from the elements and be protected from teasing/abuse. Dog is not to be chained or allowed to run at large or be off leash outside of a fenced area. We discourage the use of “dog parks”. Purchaser agrees to be responsible for any and all expenses incurred by this dog upon taking physical possession of it and to notify seller of serious illness, injury or death of dog. Purchaser agrees to keep seller informed of any changes in address or phone number(s).
Purchaser swears they are not acting as an agent in the purchase of this dog nor will purchaser sell or give away this dog to any agent, pet store, dog dealer, broker, research laboratory or guard dog business.
Under no circumstances is purchaser to rely on internet chat forums, e-mail lists or other breeders for assistance in the raising, training and/or caring for this Akita without first consulting breeder/seller.
This sales agreement is valid only for the above named purchaser and described dog. Violations will result in legal action by seller to reclaim the dog and its offspring if applicable, with no refunds being issued to purchaser and purchaser agrees to pay all expenses incurred by such action. Violations may also be subject to a $2,500 non-compliance fee being imposed on purchaser. Any legal action taken in regard to this sales agreement/contract will take place in the sellers county and state of residence.
This contract is null and void in the event the breeder/seller is no longer breeding Akitas and/or if any part of this agreement has been violated.
There are no replacements or cash refunds offered except as outlined in this sales agreement.
By signing below the purchaser and seller are agreeing to the terms and conditions set forth in this agreement in its entirety and purchaser acknowledges receipt of a copy of this sales agreement.
